Terms of Service

Who we are and what you are agreeing to

Tile Collector (tilecollector.app, the "Service") is operated by CD Works LLC, doing business as Tile Collector ("we," "us," "our"). By creating an account or using the Service you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to create an account.

Some future features, such as buying, selling, and messaging, will require you to be at least 18 (or the age of majority where you live). Before you can use them we will ask you to confirm your age and record when you did. We do not collect a birth date for this, and the confirmation is not identity verification.

By using the Service you represent that you meet these requirements and that the information you give us is accurate.

Your account

You are responsible for your account and for keeping your password secure. Tell us promptly about any unauthorized use. We may suspend or close accounts that break these terms or the law, and we may refuse service at our discretion.

Set information is for reference

The Service lists mahjong sets and mats with details gathered from makers, public sources, and members. We do not guarantee that this information is accurate or complete, and nothing on the Service is an appraisal or a promise that an item is worth any price. Maker names and product names belong to their owners and appear only to identify their products; we are not affiliated with or endorsed by any maker unless we say so.

Your content

You keep ownership of what you submit: photos, collection details, stories, notes, reviews, and anything else you post. By submitting content you give us a non-exclusive, worldwide, royalty-free license to host, display, and reproduce it as needed to run and promote the Service. You represent that you have the rights to what you upload.

Corrections and additions you make to the shared set database become part of it and stay available even if you close your account.

Copyright complaints (DMCA)

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act.

A valid notice must include: a physical or electronic signature of the copyright owner or someone authorized to act for them; identification of the work; identification of the material you say is infringing, with enough detail for us to find it (a link is best); your address, phone number, and email; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner.

On a valid notice we remove or disable the material promptly and tell the member who posted it. If your material was removed by mistake, you may send a counter-notice to the same agent. We end the accounts of repeat infringers.

Acceptable use

You agree not to:

• Harass, threaten, defraud, or spam other members.
• Post content you do not have the right to share, or content that is unlawful or misleading.
• Scrape, harvest, or bulk-download the Service, or access it with automated tools except through interfaces we provide.
• Interfere with the Service, probe its security, or get around its limits or access controls.
• Impersonate anyone or misrepresent your affiliation with a maker or anyone else.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SET INFORMATION IS ACCURATE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CD Works LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED $100.

These limits do not apply to our own fraud, gross negligence, or willful misconduct, to death or personal injury caused by our negligence, or to anything else that cannot be limited under applicable law.

Dispute resolution and arbitration

Read this section carefully. It affects how disputes are resolved and limits class actions. You can opt out within 30 days.

Start informally. Before either of us starts a formal proceeding, the party with the concern will describe it in writing to the other (you to hello@tilecollector.app, us to the email on your account), and we will try in good faith for at least 30 days to resolve it.

Arbitration. If we cannot resolve a dispute informally, you and CD Works LLC agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may instead bring an individual claim in small-claims court. Hearings are held by videoconference or, if in person, in the federal judicial district where you live.

CLASS ACTION WAIVER. Disputes must be brought individually. Neither party may bring or join a class, consolidated, or representative action. If a court finds this waiver unenforceable for a claim, that claim alone goes to court.

Opting out. Email hello@tilecollector.app within 30 days of first accepting these terms, with your account email and a statement that you opt out of arbitration. Opting out never affects your account.

Governing law

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws rules. Nothing here takes away mandatory consumer protections where you live.

Changes

We may update these terms as the Service grows. Each version has a date, and we record which version you accepted. For material changes we will ask you to accept the new terms before you continue. If you do not accept, you can stop using the Service and close your account.

We may add, change, or discontinue features. If we shut the Service down we will give at least 30 days’ notice, and you can request a copy of your collection data by email.
